These Terms and Conditions govern your use of yacht rental services provided by Marowyn Yacht Rentals. By booking our services, you agree to be bound by these terms.

1. Definitions
- "Company," "we," "us," or "our" refers to Marowyn Yacht Rentals
- "Client," "you," or "your" refers to the person or entity booking our services
- "Charter" refers to the yacht rental service agreement
- "Vessel" refers to the yacht or boat being chartered
- "Captain" refers to the licensed professional operating the vessel
2. Booking and Confirmation
2.1 Reservation Process
- All bookings must be made through authorized channels
- A signed charter agreement is required for all services
- Bookings are confirmed upon receipt of required deposit
- Charter dates are subject to vessel availability
2.2 Deposit and Payment
- 50% deposit required to secure booking
- Full payment due 7 days before charter date
- Bookings within 7 days require full payment upon booking
- Additional charges may apply for extra services
3. Charter Terms
3.1 Charter Period
- Charter period begins at agreed embarkation time
- Late arrival may result in reduced charter time
- Charter ends at agreed disembarkation time
- Extensions subject to availability and additional charges
3.2 Guest Capacity
- Guest numbers must not exceed vessel capacity
- Final guest count must be confirmed 48 hours prior
- Changes in guest count may affect pricing
- Children must be supervised at all times
4. Safety and Compliance
4.1 Safety Requirements
- All guests must follow safety briefing instructions
- Life jackets must be worn when directed by crew
- Swimming allowed only with crew permission
- No smoking in enclosed areas
4.2 Prohibited Items and Activities
- Illegal drugs or excessive alcohol consumption
- Weapons or dangerous items
- Red wine, red sauces, or staining liquids
- Pets (unless pre-approved service animals)
- Confetti, glitter, or non-biodegradable decorations
5. Weather and Cancellation Policy
5.1 Weather Cancellations
- Company reserves right to cancel for unsafe conditions
- Weather decisions made by Captain are final
- Alternative dates offered for weather cancellations
- Full refund if alternative dates not acceptable
5.2 Client Cancellations
- 30+ days notice: Full refund minus processing fee
- 15-29 days notice: 50% refund
- 7-14 days notice: 25% refund
- Less than 7 days: No refund
6. Liability and Insurance
6.1 Limitation of Liability
Company's liability is limited to the charter fee paid. We are not liable for:
- Personal injury or property damage
- Lost or stolen personal items
- Indirect or consequential damages
- Weather-related disruptions
6.2 Client Responsibilities
- Clients charter at their own risk
- Responsible for damage caused by their party
- Must disclose medical conditions affecting safety
- Agree to follow all crew instructions
7. Damage and Cleaning
- Client responsible for damage beyond normal wear
- Excessive cleaning fees may apply
- Damage assessment conducted after charter
- Repair costs charged at cost plus handling fee
8. Privacy and Personal Information
Personal information collected is subject to our Privacy Policy. We collect and use information as necessary to provide charter services and comply with maritime regulations.
9. Dispute Resolution
- Good faith effort to resolve disputes informally
- Disputes subject to binding arbitration if required
- Ontario law governs these terms
- Toronto courts have exclusive jurisdiction
10. Modifications and Updates
We reserve the right to modify these terms with reasonable notice. Continued use of our services constitutes acceptance of updated terms.
